The Supreme Court of India has issued a sharp rebuke to the Delhi Police for its inadequate enforcement of the firecracker ban in the capital city, labeling it as a mere “eyewash”. The court expressed its disappointment with the police’s approach, stating that merely seizing raw materials falls short of comprehensive action. The bench, comprising Justices Abhay S Oka and Augustine George Masih, questioned the Delhi government’s delay in enforcing the ban, noting that the ban order was issued well in advance of October 14th.
The court emphasized the fundamental right to live in a pollution-free atmosphere, enshrined in Article 21 of the Indian Constitution. “Prima facie, we are of the view that no religion promotes any activity that promotes pollution or compromises with the health of the people,” PTI quoted the bench as saying. This statement directly addresses the often-cited religious justifications for the use of firecrackers during festivals.
In response to the inadequacies in enforcement, the bench has directed the Delhi Police Commissioner to promptly notify all stakeholders of the ban and ensure a complete halt to the sale and production of firecrackers. This directive aims to strengthen the implementation of the ban and prevent the widespread use of firecrackers during upcoming festivals. The court's actions highlight the serious concern regarding air pollution in Delhi, particularly during the festive season, and underscore the importance of upholding the right to a healthy environment.
