Shiv Sena Leader Granted Bail in Defamation Case
  • Sanjay Raut, Shiv Sena (UBT) MP, granted bail after 15-day jail term.
  • Raut convicted in defamation case filed by Medha Somaiya, wife of BJP leader Kirit Somaiya.
  • Case stemmed from allegations of a INR 100 crore scam involving public toilets.

The political landscape in India witnessed a significant development on Thursday, Sept. 26, 2024, as Shiv Sena (UBT) MP Sanjay Raut was granted bail by a Mumbai court. Raut had been sentenced to 15 days of simple imprisonment after being found guilty in a defamation case filed by Medha Somaiya, wife of BJP leader Kirit Somaiya.

The case originated from allegations made by Raut against Medha and Kirit Somaiya, accusing them of involvement in a INR 100 crore scam related to the construction and maintenance of public toilets under the Mira Bhayander Municipal Corporation. These accusations were deemed defamatory by the court, leading to Raut's conviction under Section 500 of the Indian Penal Code.

The court, presided over by Judicial Magistrate (First Class) Aarti Kulkarni, imposed a fine of INR 25,000 on Raut along with the jail sentence. However, the sentence was suspended for 30 days, allowing Raut to file an appeal. The court approved applications for both suspension of the sentence and bail, granting Raut immediate release.

Kirit Somaiya, reacting to the court's decision, stated that the punishment was directed at Uddhav Thackeray, the leader of Raut's party. Somaiya alleged that Raut, despite being in power for 28 months, had failed to produce any evidence to support his claims. He further asserted that the court's leniency in the sentence was due to it being Raut's first offense, but warned of harsher penalties in future.

Somaiya also criticized the alleged pressure exerted by the then Uddhav Thackeray-led Maharashtra government, claiming it had prevented the police from accepting Medha Somaiya's complaint against Raut. He highlighted that the case was filed in May 2022 after the police refused to act on their complaint. Medha Somaiya expressed her determination to fight against baseless allegations, emphasizing that the case would serve as an example for society.

The bail granted to Sanjay Raut marks a temporary respite in the ongoing political tussle between the Shiv Sena (UBT) and the BJP. The case itself serves as a reminder of the power of free speech and the importance of accountability in public discourse. The future implications of this case, including the outcome of Raut's appeal, remain to be seen and will likely continue to shape the political landscape in Maharashtra.
