Swati Maliwal, a Rajya Sabha MP from the Aam Aadmi Party (AAP), has alleged that the CCTV camera footage from the May 13 incident involving her alleged assault by Arvind Kejriwal's aide, Bibhav Kumar, has disappeared and that edited videos are being released.
Following the incident, Bibhav Kumar was arrested and remanded to five-day police custody by Delhi's Tis Hazari Court. Maliwal claims that after being brutally assaulted by Kumar, she called the police and that Kumar then called security personnel and started recording a video.
According to Maliwal, a portion of the video has been edited, and only a 50-second clip was released. She further alleges that her phone has been formatted, deleting the full video, and that the CCTV camera footage has also vanished.
The Delhi Police allege that Bibhav Kumar did not provide the password for his mobile phone and informed them that his phone had been formatted in Mumbai due to malfunctioning. The police claim that they need to clone the data from the phone and take Kumar to Mumbai to retrieve it.
At a hearing on Saturday evening, Additional Public Prosecutor (APP) Atul Srivastava argued that Kumar was arrested today and submitted that the complainant, Swati Maliwal, is a public figure and an AAP MP who was brutally beaten and attacked in sensitive areas.
The APP further stated that they requested the DVR, which was provided on a pen drive, but the footage was found to be blank. He added that an iPhone was given to the police, but the accused is not sharing the password and that the phone has been formatted.
Advocate Rajiv Mohan, representing Bibhav Kumar, questioned the delay in filing the case and asked why Swati Maliwal was not taken for medical attention when she went to the police station shortly after the incident but left without filing a complaint.
The allegations and counter-allegations surrounding this incident have raised questions about the security and privacy of public figures and the handling of sensitive information by law enforcement agencies.
